Terms of Service

Please read these Terms of Service ("Terms") carefully before using LivelyRead (Reading App). By creating an account, giving consent on a child's behalf, or otherwise using the Reading App, you agree to be bound by these Terms. If you do not agree, please do not use the Reading App.
These Terms should be read together with our Privacy Policy and, where applicable, our Parent/Guardian Consent form.
1. About the Reading App
The Reading App is operated by KINDLIVELY PTE LTD ("we", "us", "our"), a company incorporated in Singapore. The Reading App uses artificial intelligence (AI) to help learners aged 3 to 99 learn to read through conversation, pronunciation practice and interactive stories.
The Reading App is currently offered only to users located in Singapore. We may expand availability to other countries in the future, at which point these Terms may be updated.
2. Eligibility and Accounts
- Users aged 18 and above may create and manage their own account. They must confirm they are 18 or older and verify their email address before using the Reading App.
- For users under the age of 18, a parent or legal guardian must create the account, complete the Parent/Guardian Consent step, and then verify their own email address before the child may use the Reading App.
- You agree to provide accurate information when creating an account (including via Google Sign-In) and to keep your account credentials secure.
- You are responsible for all activity that occurs under your account.
3. Parental Responsibility
A parent or legal guardian who creates an account or gives consent on a child's behalf is responsible for:
- supervising the child's use of the Reading App;
- ensuring the child's use complies with these Terms; and
- any credits purchased or used through the account.
4. The AI Reading Tutor — Nature and Limitations
- The AI reading tutor generates responses automatically and may occasionally make mistakes, misunderstand speech, or respond imperfectly. It is not a human teacher and is not a substitute for professional teaching, tutoring, speech therapy, or educational assessment.
- The AI reading tutor is designed to stay focused primarily on reading and the learning material being used, and may decline to discuss unrelated topics.
- We do not guarantee any particular learning outcome, reading level, or rate of progress from using the Reading App.
- If you have concerns about a child's reading development, please consult a qualified teacher or other professional.
5. Credits and Payment
- Certain features, including AI reading tutor sessions, are paid for using credits added to an account through top-ups.
- Credits are consumed based on actual usage of the AI reading tutor.
- Free starting credit, where offered, is limited to one per Google account and may be limited to a set number of early sign-ups. Deleting an account and creating a new one with the same Google account does not give free starting credit again. If no free credit was given, the parent page in the app says why.
- An AI reading tutor session can only be started when the credit balance is more than $0.20, so that a session is not cut off moments after it begins. A smaller remaining balance cannot be used for a session and will expire as described below unless the account is topped up.
- Credits are non-refundable, except where required by applicable law or where we decide otherwise at our discretion.
- Credits expire 12 months after your most recent top-up. Each top-up extends the expiry of your whole remaining balance to 12 months from that top-up's date. Any free credits given when an account is created expire 12 months after the account was created, unless extended by a top-up. Any balance still unused on the expiry date will be forfeited, except where applicable law requires otherwise. The expiry date is shown on the parent page in the app.
- We may change the price of credits, top-up amounts, or how credits are consumed at any time, with reasonable notice for material changes.
- If an account is closed, any remaining credit balance may be forfeited, except where applicable law requires otherwise.
6. Acceptable Use
You agree not to:
- use the Reading App for any purpose other than personal reading practice and learning;
- attempt to interfere with, disrupt, overload, or gain unauthorised access to the Reading App or its underlying systems;
- attempt to extract, reverse-engineer, or misuse the AI models, prompts, or logic behind the AI reading tutor;
- use prompt injection or any other technique that attempts to bypass, disable, or manipulate the AI reading tutor's safety guardrails, or to force the AI reading tutor to produce harmful, unsafe, or otherwise prohibited content;
- scrape, copy, or redistribute reading content or app functionality for commercial or unauthorised purposes;
- provide false information, including falsely claiming to be a child's parent or legal guardian; or
- use the Reading App in any way that is unlawful, abusive, or harmful to children.
We may suspend or terminate access for any account that violates these Terms.
7. Content and Intellectual Property
- The Reading App's design, software, and original reading materials are owned by us or our licensors and are protected by intellectual property laws. Some reading materials may be based on public-domain works.
- We grant you a limited, non-exclusive, non-transferable licence to access and use the Reading App for personal, non-commercial reading practice.
- You may not copy, modify, distribute, sell, or commercially exploit any part of the Reading App or its content without our prior written permission.
- Conversational responses generated by the AI tutor are provided for your personal use within the Reading App only.
8. Third-Party Services
The Reading App relies on third-party service providers for functions including AI processing, account authentication, cloud hosting and payment processing, as described in our Privacy Policy. Your use of features involving these providers may also be subject to their applicable terms.
9. Service Availability and Changes
- The Reading App is provided on an "as is" and "as available" basis. We may modify, suspend, or discontinue the Reading App or any feature, temporarily or permanently, with or without notice (for example, for maintenance or updates).
- We may add, remove, or change reading content, decks, or features over time.
10. Disclaimers
To the maximum extent permitted by applicable law, the Reading App is provided without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Reading App will be uninterrupted, error-free, or completely secure.
11. Limitation of Liability
To the maximum extent permitted by applicable law:
- we will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Reading App; and
- our total aggregate liability to you for any claim arising out of or relating to these Terms or the Reading App will not exceed the amount you paid us for credits in the 12 months before the claim arose.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
12. Indemnification
If you breach these Terms — for example, by using the Reading App for an unlawful purpose — and that breach results in a claim, lawsuit, investigation, or fine against KINDLIVELY PTE LTD, you agree to indemnify us and cover the resulting reasonable legal fees and damages, to the extent permitted by applicable law. This does not apply to the extent the claim arises from our own breach of these Terms, negligence, or wilful misconduct.
13. Termination
- You (or, for a child's account, the parent or legal guardian) may stop using the Reading App and close the account at any time by contacting us at admin@kindlively.com.sg. See our Privacy Policy for how to request deletion of stored information.
- We may suspend or terminate your access to the Reading App at any time, including for breach of these Terms, misuse of the service, or as required by law.
14. Governing Law and Disputes
These Terms are governed by the laws of Singapore, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Reading App will be subject to the exclusive jurisdiction of the courts of Singapore. Before starting formal proceedings, we encourage you to contact us first so we can try to resolve the issue directly.
15. Changes to These Terms
We may update these Terms from time to time, including if the Reading App, applicable laws, or the services we rely on change. Continued use of the Reading App after changes take effect constitutes acceptance of the updated Terms. If we make significant changes affecting children's use of the Reading App, we will notify parents and, where appropriate, seek renewed consent.
